On drinking and driving:

New York has a Zero Tolerance Law for drivers who are under the age of 21 with blood alcohol count of .02 to .07. For drivers who are 21 and over and found to have a blood alcohol count of .05 to .07, they will be charged with DWAI/ Alcohol, which is a ground for your arrest.

For drivers who are found with blood alcohol count of .08 and higher, which shows extreme intoxication, he/ she will be charged with DWI with stiffer penalties.
